The property, notwithstanding any description contained in these particulars, is sold subject to any Development Plan, Tree Preservation Order, Town Planning Scheme, Resolution Notice, which may be or may come to be in force and also subject to any statutory provision or Bye-laws without any obligation on the part of the vendor to specify them.

Section 106 Agreement
The council have assessed the site pursuant to its statutory duty under Regulation 63 of The Conservation of Habitats Species Regulations 2017 finding that the development is likely to give rise to additional phosphates within the catchment of the Ramsar site. It has been agreed between the vendors and the vendors family that a Package Treatment Plant (PTP) will be installed and maintained at their property which will ensure phosphate neutrality on the site. There is a Section 106 agreement detailing the agreement between parties which will run with the planning consent. The installation of the PTP will be completed by the vendors within three months of completion. These works will be carried out at no cost to the prospective purchaser. Should prospective purchasers seek to vary the current planning consent giving rise to additional phosphate offset, it will be their responsibility to satisfy the additional amount.

Overage Clause
The land will be sold subject to an overage clause which will be triggered in the event that planning consent is obtained for the erection of more than one dwelling house. In the event this overage clause is triggered, a payment equivalent to 25% of the uplift in market value of the land with the benefit of planning consent for more than one dwelling will be payable and this will run for 25 years from the date of completion.

Access
The development site will be accessed directly from Newtown Lane in line with the reserved matters granted as detailed within the planning consent. Prospective purchasers will be responsible for installing the access.

Wayleaves and Easements
There will be a right granted to the purchaser over the vendors retained land allowing the discharge of surface water into a clean water ditch. Other than this the property is sold subject to all easements and wayleaves of telegraph and telephone poles and stays and wires, and electric pylons, pipes (whether poles and cables, water, gas and other referred to in these Particulars or not) at present erected on and passing over or under the property, and subject to the Agreements affecting the same (if any) and to the Town and Country Planning Scheme, or County, Local Authority or any other statutory body affecting the same.
