Location & Access - The land as edged red on the enclosed plan is situated in the Parish of Ashby by Partney, with access via two rights of way as shown edged dotted blue on the attached plan. It will be the responsibility of the incoming Tenant to maintain Western access and a proportional cost of maintenance of the eastern access.
Farm Business Tenancy - The land will be let on a Farm Business Tenancy agreement for an initial term of 5 years. If both parties decide the agreement will continue thereafter on a year to year basis as an annual periodic agreement, which will be determined by either party, giving between 12 and 24 months written notice to terminate. The Tenancy Agreement to be used is produced by the Lincolnshire Association of Agricultural Valuers (a copy of which is available upon request). It is proposed that the Tenancy will commence on the 5th October 2023, however this could be arranged earlier with agreement.
Rent - The rent shall be fixed for an initial term of 3 years. The rent will be payable half yearly in advance.
Rights Of Way, Easements, Wayleaves - We are not aware of any rights which affect the land; however, all of the land is sold subject to and with the help and benefit of all existing rights, including rights of way whether public or private, light, support, drainage, water and electricity supplies and other rights, easements, and all wayleaves whether referred to or not in these particulars.
Underdrainage - We understand that the land has been underdrained. Please contact the agents for copies of the underdrainage plans
Rural Payments Agency - The land is registered with the Rural Payments Agency.
Stewardship Schemes - The land is not included in any Stewardship Schemes. If the incoming Tenant wishes to enter land into any Stewardship or SFI Schemes, then the Landlords prior written consent will be required.
Cost Of Tenancy Agreement - The incoming Tenant shall be responsible for a 50% share of the cost to prepare the Farm Business Tenancy Agreement.
Tenant Right & Dilapidations - Upon entry there will be no payment for Tenant Right nor any counterclaim for dilapidations. The Tenant will be expected to farm in accordance with the Rules of Good Husbandry and will be responsible for the maintenance of ditches, culverts and hedges where appropriate. The Landlord reserves the right to make a claim against the Tenant at the termination of the Tenancy for Dilapidations should this prove necessary.
Drainage Rates - The drainage rates are payable to Lindsey Marsh Drainage Board and will be the responsibility of the incoming Tenant.
Sporting, Timber & Mineral Rights - Sporting Rights are excluded from the letting insofar as they are owned, subject to statutory exclusions.
