General Information -
Location - The land forms part of the Birstwith Hall Estate, Harrogate. The Land is located to the North of the Skipton Road (A59), with one parcel to the south of the A59, just to the south of the village of Birstwith, Harrogate. The Land is approximately 5 miles to the west of Harrogate.
Lot 1 is accessed via the A59 to the south or via Barse Beck Lane and Swincliffe Lane to the north.
Lot 2 is accessed via Back Lane to the West, Tang Road, and Swincliffe Lane.
The nearest postcode is HG3 2LA.
Description - The land is split across a number of parcels and extends to approximately 184.82 acres (74.79 ha) as edged red on the attached plan. The main access is via Barse Beck Lane and Tang Road from White Wall Lane leading south from the A59. Most fields are a good size suitable for a mix of grazing and mowing.
All the land is classified as being within the Brickfield 3 Soil Series. Brickfield 3 Soil Series are described as being slowly permeable seasonally waterlogged fine loamy, fine loamy over clayey soils and clayey soils. The Agricultural Land Classification identifies the land as being Grade 3 and Grade 4.
Services - A water connection is available to the land. To be charged in addition to the Licence Fee.
Plans - Areas have been shown based on information from the RPA's plans. Lot 1 shaded yellow and Lot 2 shaded Blue on the attached site plan.
Main Terms Of Agreement - The property is available to be let on a Farm Business Tenancy Agreement, either as a whole or in separate lots under the Agricultural Tenancies Act 1995. The Tenancy will be for an initial period of 5 years commencing on 1st November 2023 and until 30th October 2028. A copy of the Farm Business Tenancy is available for inspection at the Agent's offices.
Break Clause/ Review - There is to be a Landlord and Tenant break clause on the 3rd anniversary of the tenancy. In addition, if an alternative use is obtained by the Landlord, the tenancy can be terminated.
The rent may also be reviewed on the 3rd anniversary.
Rent Payment - The rent will be payable half yearly in advance on 1st November & 1st June with the final payment being on 1st June 2028.
Basic Payment Scheme - There are no Basic Payment Scheme Entitlements available with the land.
Stewardship Schemes - The land is not included within any Countryside Stewardship Scheme. Prospective tenants wishing to enter the land into a Countryside Stewardship Scheme or any other scheme should discuss this with the agent prior to submission of the tender.
Nitrate Vulnerable Zone - The land is not located within a Nitrate Vulnerable Zone.
Historic/ Acheaological Finds - The Landlord will retain the right to all historic/ archaeological finds found on the property.
Cost Of Agreement - The successful Tenant will be expected to contribute £400 plus VAT towards the cost of setting up the Farm Business Tenancy.

Possession - The land will be available for possession on the 1st November 2023.
Other Rights - All Sporting, Timber and Mineral Rights will be retained by the Landlord.
Easements And Wayleaves - The land is let subject to all easements and wayleaves whether formally mentioned in the Tenancy Agreement including these letting details or not. The Landlord will reserve the right to retain the payment for all easements and wayleaves on the land.
Outgoings - The Tenant will be responsible for any outgoings on the property.
Rights Of Way - The prospective tenant will have a right of way over the main drive to Woodside Farm and for an area within the yard to turn vehicles. This access is shaded brown on the Plan.
