Important Notes

The cottages currently share a septic tank, which we understand would need to be replaced to meet current standards. Prospective buyers must make their own investigations into suitable replacement/ alternatives. The LPG (gas) tank is also currently shared. Our client has advised that the land on which the gas tank is currently sited may be sold with the cottages, with access from the road and a right of way over the field, by negotiation.

The seller has proposed the following covenants, subject to contract:

1. Planning gain/ overage agreement (50% of any gain for 25 years) to cover all forms of development, including any additional dwellings. However, buildings and other structures ancillary to a domestic use will not trigger the overage but plans for garaging, outbuildings etc. will require the prior approval of the sellers but this will not be unreasonably withheld or delayed.

2. Non-compete clause. The additional land is for agricultural and domestic garden use only and will not be used for camping, caravans or cabins rented out for holiday homes in competition with the business of Lenchwood Trust. Neither are caravans and cabins to be used for permanent residential lettings. No permanent structure such as sheds, greenhouses, chicken runs, etc. to be erected without the prior approval of the sellers, such consent not to be unreasonably withheld or delayed. No livestock will be kept on the property, except for domestic pets.

3. Not to object to any planning application for change of use and/or development of the Trust retained land for holiday or conference use, save where such application materially adversely affects the transferee's use of their property.

4. Lenchwood Trust agrees to restrict any amplified sound from its activities to the hours of 9am until 10.30pm.
