The Farm Business Tenancy
The land at Milstead Manor Farm is let on a Farm Business Tenancy for a term of 20 years commencing on 1 November 2016. The passing rent is £42,260 per annum payable half yearly in arrears. Rent reviews are any anniversary of the term commencement date occurring not less than five years after the date with effect from when the market rent was previously agreed. The next possible rent review is the 1 November 2024 subject to either party serving the appropriate notice.

The tenant, at their expense, has planted the fruit trees as a tenant’s improvement and all planting costs are to be written down by straight line depreciation over 15 years. The trees planted in certain orchards were planted under the terms of an earlier farm business tenancy agreement and the write down period commenced on the 1 November 2013. The trees planted within the remainder of the property are to be written down from the 1 November 2017.

The tenancy agreement does not include a tenant only break provision.
