Situation

1 Wells Cottage is situated on a country lane in an easily accessible location to the east of the A251 Faversham Road and north of the A252. Faversham and the M2 lie to the north and Canterbury to the east and Ashford with its M20 connections and railway station to the south. High speed HS1 trains are available at both Faversham and Ashford into London St Pancras. The Cottage was a former farm workers cottage to Wellhouse Farm which formed part of the Sondes Estate. Extended in about 2004, the cottage provides comfortable and well presented accommodation on 3 floors and sits in a 1/5th acre garden.

1) The Cottage has an Agricultural Occupancy Condition dated August 2005 following the removal of the condition by a previous owner from another property under planning reference 04/01333/AS which was then ‘added’ to 1 Wells Cottages (then known as 1 Wellhouse Cottages) under planning reference 04/01331/AS.
Under the terms of a Section 106 Planning Agreement that accompanied the application a planning condition states that the property must be occupied by an Agricultural Employee meaning ‘’A person solely or mainly working or last working in the locality in agriculture (as defined in Section 336 of the Town and Country Planning Act 1990) or forestry or a widow or widower of such a person.’’

2) ‘’Agriculture’’ is defined in the Town & Country Planning Act as: horticulture, fruit growing, seed growing, dairy farming, the breeding and keeping of livestock (including any creature kept for the production of food, wool, skins or fur, or for the purpose of its use in the farming of land), the use of land as grazing land, meadow land, osier land, market gardens and nursery grounds, and the use of land for woodlands where that use is ancillary to the farming of land for other agricultural purposes, and “agricultural” shall be construed accordingly.
