The property offers a rare opportunity to purchase an appealing portion of bare land along the South Devon National Landscape. The majority of the property is surrounded by traditional hedgerows and livestock fencing, benefiting from access to the public highway and well defined footpath network.

The land is subject to a Landscape and Environmental Management Plan (referred to below) that has necessitated the use being agricultural conservation grazing for a number of years.

SERVICES
We are not aware of the services available to the land by note that there is piped water to some parcels. We assume this relates to mains water connections but do not have details of the meter or connection points. Each lot is sold with any water supply that may already exist and purchasers of each lot shall benefit from a right of supply over the adjoining lots to continue these supplies, however they shall be liable to installation of sub-meters as necessary.
We do not believe there are any other services connected to the benefit of the land but purchasers are advised to make their own investigations.

RESTRICTION ON USE—LANDSCAPE AND ENVIRONMENTAL MANGEMENT PLAN
The land is subject to an extensive Landscape and Environmental Management Plan (LEMP) that is the result of a section 106 agreement following the grant of planning consent originally under reference P/2013/0785. There were numerous applications submitted after this that amend the original consent. It is understood that the LEMP is enforced under the S.106 agreement and must continue this management for in the region of 15 years. We do not believe there are any restrictions upon expiry but potential purchasers are advised to make their own investigations and consider any limitation and obligations that may impact on their intended use. For the avoidance of doubt, the LEMP limits the use of the land but also imposes specific management requirements.

DESIGNATIONS & PERMISSIVE PATH
The property is entirely located within the South Devon National Landscape. There are no other known formal designations.
The Berry Head footpath is understood to be a permissive footpath that crosses the subject property and responsibility lies with the landowner to maintain under the LEMP.

VIEWING
Interested parties may view the land with a copy of these particulars to hand. The majority of the land can be viewed from the permissive footpath to the south and parties are requested not to access the land beyond public accessibly locations.
Parties are advised to register their interest with the agents in the event an acceptable offer is received prior to auction; in this situation the agents shall endeavour to notify them of the property being withdrawn from the market. It is however considered unlikely that the property will be sold prior to auction.

GUIDE PRICE*
An indication of the seller’s current minimum price at auction. The guide price of range or guide prices is given to assist consumers in deciding whether or not to pursue a purchase. It is usual, but not always the case that a provisional reserve range is agreed between the seller and the auctioneer at the start of marketing. As the reserve is not fixed at this stage and can be adjusted by the seller at any time up to the day of auction in the light of interest shown during the marketing period, a guide price is issued.
