Situation - On the edge of Porthtowan at the end of Jollys Lane. The north coast, cliffs and beach are a short walking distance to the north.

Description - LOT 1 - Detailed Planning Permission was granted by Cornwall Council on 14th April 2022 (PA21/11470) for the conversion of the single storey and two storey barns to residential dwellings.

Barn 1 is a two storey traditional stone barn under a slate roof and the permission allows for conversion to create a one-bedroom dwelling - although it is considered there may be potential to create a 2nd Bedroom subject to all necessary consents. Building 1 extends to c.1,076 sq ft (gea). Barn 2 is a long single storey traditional barn in a poor state of repair and the consent is for conversion to create a three-bedroom detached residence. In total Building 2 extends to c.1,388 sq ft (gea). Outside are areas for parking and creating gardens.

LOT 2 - Prior Approval was granted by Cornwall Council on 4.4.2022 (PA21/11472) under Class Q, Part 3 of Schedule ll of the Town and Country Planning (General Permitted Development) (England) Order 2015 for the conversion of the building to create a three-bedroom single storey residential dwelling. The Barn extends to c1,219 sq ft (gea) and outside are car parking areas and a good-sized garden area.

Completion Date And Sold As Seen - The completion dates will be as dictated by the legal packs. Lots 1 and 2 will be sold as seen.

Buyer'S And Administrative Fees - The successful Purchasers of each Lot will be liable to pay the sum of £5,000. From this a Buyer's fee of £2,400 inclusive of VAT is retained by Stags/Bamboo Auctions as a condition to the online platform costs, and £2,600 forms part of the 10% deposit. The Purchaser will be required to pay the balance of the 10% deposit monies within 24 hours of the auction via their solicitor to the Vendor's solicitor. We therefore recommend all bidders clear the Anti Money Laundering Regulations with their solicitor prior to the auction.
An additional administrative fee separately invoiced by Stags of £1,200 inclusive of VAT, will be payable by the successful Purchasers of each of the Lots immediately after the auction.

Definition Of Auction Guide And Reserve Price - Guide Price(s) is an indication of the Seller's expectation. Reserve Price(s) is a figure below which the auctioneer cannot sell the Lots at auction. We expect the reserve to be no higher than 10% above the guide. Guide prices may change at any time prior to the auction.

Proof Of Identity - Under Money Laundering Regulations 2007, it is a requirement for Estate Agents to perform due diligence checks to any person that intends to bid at auction. There is a requirement for all bidders to register via the online sale site and complete the ID checks. There is no charge for registration.

Boundaries - Plan For Identification Purposes Only - Lot 1 - will be required to erect a boundary of posts and two rails between points A, B, C, D and F and G and between points G, H and J, and a hit and miss timber fence 6' high above ground level to within two months of completion.
Lot 2 - will be required to erect a boundary of posts, sheep netting and two rails between points F, K and M within 2 months of completion, and a 6' high above ground level hit and miss timber fence between points M and P by 1st May 2023.

Covenant - Lot 1 - The purchaser of Lot 1 will covenant to install and retain opaque/obscure glazed windows on the first floor of the south west elevation of Barn 1.

Temporary Right Of Way And Storage - Where necessary, Lots 1 and 2 will be granted a temporary right of way over neighbouring retained land to bring building materials to site and store building materials on an adjacent parcel of land up until 1st May 2023. Lots 1 and 2 to be responsible for insuring their own materials and belongings.

Directions - From the car park in Porthtowan, turn left and drive away from the beach. At the T junction, turn right, drive up the hill for about 300 yards, bear right into Forthvean Road and after about 50 yards, turn sharp right into Jollys Lane. Follow the lane to the left and continue up the hill until seeing the barns on the left.

Services - Water distribution main in Jollys Lane adjacent to Lot 1. Electricity pole situated on retained land c.80 yards to the west. It is envisaged that the private drainage systems for Lots 1 and 2 will be installed and laid within the grounds/boundaries of each lot.
